Terms and conditions
PREMISE
The services provided by Bag Drop S.R.L. are governed by these “Terms and Conditions of Service”.
The “Terms and Conditions of Service” established by Bag Drop S.R.L. must be understood and considered an integral part of each individual storage contract and of each other service concluded with the Customer and cannot be separated from the contract itself.
DEFINITIONS
The following definitions apply to the “Terms and Conditions of Service” that regulate the storage contract and for each other service concluded with the customer: “we”, “us”, “our”, the “personnel in charge” means Bag Drop S.R.L. and any partners and collaborators of Bag Drop S.R.L.; “Customer/s”, “you” and “your” means the customer who is the holder of a storage receipt hereinafter “receipt”.
TERMS AND CONDITIONS
The contract for storage and other services is stipulated with the Company Bag Drop S.R.L., owner of the Bag Drop brand and the website www.bagdrop.it, which agrees to store its customers’ luggage/objects in its own luggage storage facilities. By leaving your luggage in our premises and in the luggage storage facility, you accept the terms and conditions set out in our storage contract and/or in the contract for the provision of various services, on your own behalf and/or on behalf of any other interested person.
DESCRIPTION OF THE SERVICE – SELF-SERVICE LOCKERS
The luggage storage service consists of the rental of automatic lockers for the storage of luggage/personal objects at our stores for the period chosen by the customer during the booking phase.
- The Customer is informed that he/she has no right to withdraw from the transaction, which he/she expressly waives in light of the specific nature of the service.
- The offices are open seven days a week, from 08:00 to 21:30.
- Smoking is not permitted inside our luggage storage areas.
- Access (to the service) is limited to persons over the age of 18 or accompanied minors.
- The maximum weight allowed per locker is 30 KG.
- It is not possible to store bulky objects that exceed the normal dimensions of the locker by forcing the locker to close, as this could cause damage to the locking mechanism of the locker itself and the Customer will be required to pay the costs of intervention and replacement.
- The Customer is required to verify that the dimensions and weight of his/her luggage are adequate for the locker he/she intends to rent. For this purpose, a specific size guide is available in the store and on the website.
- No complaint or request for reimbursement will be accepted if the baggage exceeds these dimensions and/or weight.
- The Customer is also required to ensure that the locker door is properly closed before leaving the luggage storage facility used;
- The baggage is locked inside the locker rented by the customer;
- It is not possible to store valuables, cash, weapons, perishable food and foodstuffs, live animals, illicit substances in general, explosives and flammable material. By accepting the rental terms, the customer expressly exonerates Bag Drop S.R.L. from any liability in this regard.
- The Customer exonerates Bag Drop S.R.L. from any liability in this regard. in the event that you forget one or more items inside the lockers at the end of the rental, or if you have not used the diligent care of a good father of the family, ensuring that you have properly closed the locker during your rental.
- The Customer is in any case responsible for his/her baggage and its contents.
It is the Customer’s responsibility not to leave any identity documents or other items necessary for the trip in the locker. The Customer acknowledges that he/she has taken all necessary precautions and measures to ensure that he/she has not left any documents necessary for the trip in the locker. In the absence of this, Bag Drop S.R.L. will in no case be held liable for any negligence on the part of the Customer.
LATE COLLECTION IN THE SELF-SERVICE LUGGAGE STORAGE
In the event of a request for late collection of the baggage after opening hours, Bag Drop S.R.L. may charge a minimum supplementary cost of €35 for manual intervention by one of its operators. Once the payment has been made, the Customer will be able to collect the luggage.
In case of late collection during opening hours, the system will automatically request the integration of the payment for the extra days and any late payment charges.
FORGOTTEN/FOUND LUGGAGE
For security reasons, any item or baggage that is forgotten/found and not claimed will be destroyed 5 days after the end of the booking.
If a forgotten item is requested to be shipped, the Customer assumes all costs, which must be paid in advance. A contribution of €35 will be required plus shipping costs, which depend on the weight, destination and shipping method (regular mail, UPS, etc.).
PROHIBITED AND DANGEROUS ITEMS
The storage of items prohibited by law and/or considered dangerous under national legislation is not permitted, as well as items that by their nature or packaging may cause harm to people, the environment or other baggage transported and/or stored.
We do not accept storage, nor provide any other services for goods that in our sole discretion are considered dangerous.
Bag Drop S.R.L. does not accept deposit for the following items: plants and animals, alive or dead; negotiable securities and certificates (bills of lading, currencies, banknotes, coins, credit cards and travellers cheques (travel documents)); other non-negotiable securities; any material that could be considered pornographic or indecent; weapons (firearms and cutting weapons); software containing high-value information; technology (telephone, tablet, PC, smartphone); rubbish; political material; dangerous materials; narcotics or psychotropic substances; art objects; antiques; metals (gold, silver in any form and precious stones); bulky goods; documents (public and private offers, securities, meal vouchers and fuel vouchers, etc.); watches.
The customer acknowledges and accepts that the deposit of such goods is subject to specific regulations. The entrustment must therefore take place in accordance with current legislation and any operational provisions dictated by Bag Drop S.R.L. These indications may change at any time.
RIGHT OF INSPECTION
The Customer acknowledges and accepts that Bag Drop S.R.L. and/or any Government Authority have the right to open and inspect the baggage at any time for security reasons.
CUSTOMER OBLIGATIONS
The customer guarantees and declares that he/she has read and accepted these Terms and Conditions and expressly agrees not to deposit prohibited and dangerous objects.
EXTENT OF OUR LIABILITY
Our liability for the risks of loss or damage to your baggage during the period of storage at our headquarters and specifically attributable to the sole responsibility of Bag Drop S.R.L. or its employees, will be governed by art. 1768 and no. 1770 of the Italian Civil Code and in any case cannot, under any objective and/or subjective circumstances, exceed the amount of €500.00 per bag.
For the part not contemplated by the provisions of the civil code on the storage contract, no liability is attributable to Bag Drop S.R.L. in the event of baggage/baggage delayed and/or not collected beyond the opening/closing hours of our premises.
Therefore, Bag Drop S.R.L. will not be liable in any way in relation to damages duly and fully proven, which can be considered a direct and foreseeable or indirect consequence of the delay and/or failure to collect.
Bag Drop S.R.L. will not be liable for any flights, trains, start-ups, loss of earnings, profit, market, reputation, customers, use, opportunities, even if we were aware that such loss or damage could occur, nor for any loss or damage, regardless of the indirect, incidental, special or consequential damages determined, including, by way of example, cases of termination of the contract, negligence, fraud or non-fulfilment. We will not be liable if we fail to perform any obligation to you because of circumstances beyond our control such as (the following list is purely illustrative and not exhaustive): acts of God including earthquakes, cyclones, storms, floods, fires, disease, fog, snow or frost; acts of God including (but not limited to) war, accidents, acts of terrorism, strikes, embargoes, local disputes or riots; national or local disruptions; hidden defects or inherent defects in the contents of stored baggage; criminal acts of third parties such as theft, robbery and arson; acts or omissions attributable to you or to a third party for whose work you are responsible; acts or omissions attributable to a public official; the contents of the consignment consisting of any item which is a prohibited item by law or under the provisions of this contract, even if we may have accepted the consignment and/or storage in error. We are not liable for broken handles and/or wheels. Our sole liability in relation to the services provided is governed byfrom these general storage conditions.
COMPLIANCES, DISPUTES
If a customer wishes to file a complaint for loss or damage to luggage, or for any other damage, he or she must comply with the provisions of national law; otherwise we reserve the right to reject the complaint. In particular, it is possible to send the complaint in writing within eight (8) calendar days from the end date of the locker rental. After the first written communication, and no later than the limitation period provided by law or applicable regulations, the customer must provide documentary evidence of the complaint by sending all useful information relating to the incident. We are not obliged to act on any complaint until our storage fees and commissions have been paid. The customer has the right to deduct the amount of the complaint from the amounts due for the rental to Bag Drop S.R.L.. In order to take into account a claim for damages, the contents of your luggage will be made available to us for inspection upon collection. If we accept the claim, the customer warrants that the insurance company or third parties having an interest in the storage will waive any rights or claims to which they are entitled by virtue of subrogation or otherwise.
RATES AND PAYMENT TERMS
For the automatic locker rental service, the charge will be made to the credit card at the time of purchase. It is possible to pay in cash by entering the exact amount, since the machine does not give change.
When selecting the rental days, the Customer must select a whole number greater than or equal to “1”. The system allows the entry of decimal values, but at the time of check out it will again require payment of the full amount due for the rental.
Any disputes regarding charges must be received in writing no later than seven (7) days from the date of payment. The current rates applicable to the storage service are displayed at our point of sale and on our website. The customer agrees to pay the amount due to Bag Drop S.R.L. governed by these conditions within the agreed terms. Payments will be made in local currency, and calculated based on the current exchange rate. Late payments may result in the application of default interest pursuant to Legislative Decree no. 231/02 and subsequent amendments. Bag Drop S.R.L. reserves the right to demand, without prejudice, reimbursement of its credits within the time and manner established by law, without prejudice to
APPLICABLE LAW
If any term or condition of this Agreement is declared invalid or unenforceable, such determination shall not affect the other provisions of this deposit agreement, which shall remain in full force and effect. Except for the provisions of any applicable law; any dispute arising from and/or connected to this deposit agreement shall be governed by Italian law.
JURISDICTION
For any dispute relating to the relationship between the parties, the consumer court shall have exclusive jurisdiction pursuant to art. 33 paragraph 2 of Legislative Decree number 206/2005 and subsequent amendments.
